This Privacy Policy also explains how you can exercise any privacy rights that are conferred to you by your jurisdiction of residence. This Privacy Policy only applies to personal information that is processed by VideoShops in our capacity as a business or other similar term under applicable data protection laws. Except as otherwise stated herein, this Privacy Policy does not apply to any uses of personal information by a VideoShops “Merchant” (as defined below) or any personal information that VideoShops processes on behalf of the Merchant. If you are a customer of a Merchant, you should check the privacy policies of the Merchant to understand how they may use your Personal Information. The “Services” (as defined in the Terms of Use) may, from time to time, contain links to and from the websites of other businesses. If you follow a link to any of these websites, please note that these websites have their own privacy notices and that we do not accept any responsibility or liability for their privacy obligations. Please check their privacy notices before you submit any personal information to these websites.
By using or accessing our Services in any manner, you acknowledge that you accept the policies provided in this Privacy Policy, and you consent to VideoShops’ collection, use, and sharing of your information as provided herein.
All defined terms used in this Privacy Policy shall be accorded the same meaning as provided in the Terms of Use (unless otherwise provided herein) and shall be subject to the Terms of Use. If you are a VideoShops Merchant listing your products for sale on VideoShops (a “
Merchant”), you will also be bound by the Merchant Agreement.
What does this Privacy Policy cover?
This Privacy Policy covers how VideoShops handles personally identifiable information ("
Personal Information") that VideoShops gathers when you are accessing or using our Services, but not to the practices of companies that VideoShops does not own or control, or with respect to individuals that VideoShops does not manage.
VideoShops gathers various types of Personal Information from its users, as explained in more detail below, and VideoShops uses this Personal Information internally in connection with our Services, including to personalize, provide, and improve our Services, to allow you to set up a user account and profile, to contact you and allow other users to contact you, to fulfill your requests for certain products and services, and to analyze how you use our Services.
In certain cases, we may also share some Personal Information with third parties, but only as described below. As noted in the Terms of Use, VideoShops does not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not attempt to register to use the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. Will VideoShops ever change this Privacy Policy?
We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time, but we will alert you to changes by placing a notice on VideoShops or by sending you an email. If you use our Services after any changes to the Privacy Policy have been posted or provided to you, you will be bound by those changes.
What Information does VideoShops Collect?
Personal Information is any information relating to an identified or identifiable natural person. “
Process” or “
Processing” means any operation which is performed upon Personal Information. The types or categories of Personal Information we collect and how we collect and Process such Personal Information depends on the nature of the relationship you have with VideoShops and the requirements of applicable law. We may collect the following information:
Information you provide to us: We receive and store any information you knowingly provide to us, including Personal Information and transaction information when you use the Services, when you communicate with us, and information you may provide to us in connection with surveys, contests, or sweepstakes; which may include the following categories:
Profile and Contact Information: We receive contact or other profile information when you sign up for or interact with the Services, which may include name, shipping address, email address, profile picture, or other information you choose to provide us. We may link this information to the different devices or accounts you use when you interact with VideoShops or use the Services.
Device Information: We receive information about the computers, phones, and other devices you use or interact with VideoShops or use the Services, including IP address (which may be used to determine general location), device identifiers, cookie IDs, the browser you use, your network connection, or other unique identifiers or device information.
Payment Information: We receive payment information when you make a purchase through the Services, such as your payment card number and expiration date.
Use of the Services: We receive information regarding your use of or interactions with the Services, whether or not you are logged in to VideoShops, such as your interactions with Merchants, the Seller VideoShops you visit, the products you view and visit, the product reviews and ratings you post and share, your order history, your interactions with the Services or other marketing activities related to the Services.
Settings and Privacy Preferences: We receive information about your settings and preferences on VideoShops, as well as information about your browser and device privacy settings.
Communications with VideoShops: We receive information, including message and email content, when you communicate with VideoShops (such as for customer support inquiries, taking surveys, participating in promotions or research).
I
nformation from other sources: When you make a purchase from a Merchant using the Services, VideoShops collects information about your purchase such as order information, shipping information, order updates, purchase frequency, merchant account information, and any rewards or discounts applicable to your purchase. VideoShops may also obtain information about you from other sources, including publicly or commercially available information and through third-party partners and service providers. If you provide your third-party account credentials to us or otherwise sign in to the Services through a third party site or service, you understand some content and/or information in those accounts (“
Third Party Account Information”) may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy; for example, the basic profile information we receive from third party services about you, including your name, gender and age range, is Third Party Account Information covered by this Privacy Policy. Certain information may be required to register with us or to take advantage of some of our features.
Information Collected Automatically: Whenever you interact with our Services, we may automatically collect certain information on our server logs from your browser or device, which may include your Internet protocol (IP) address, technologies including cookie identifiers and mobile advertising identifiers, mobile carrier, MAC address, IMEI, and other device identifiers that are automatically assigned to your device, browser type and language, geo-location information, hardware type, operating system, Internet service provider, pages that you visit before and after using the Services, the date and time of your visit, the amount of time you spend on each page, information about the links you click and pages you view within the Services, and other information about actions taken through use of the Services. “
Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people. You may be able to change the preferences on your browser or device to prevent or limit your device’s acceptance of Cookies, but this may prevent you from taking advantage of some of our features. To the extent that we provide advertising on VideoShops, our advertising partners may also transmit Cookies to your browser or device, when you click on ads that appear on our Services. Also, if you click on a link to a third-party website or service, a third party may also transmit Cookies to you. Again, this Privacy Policy does not cover the use of Cookies by any third parties, and we aren’t responsible for their privacy policies and practices. Please be aware that Cookies placed by third parties may continue to track your activities online even after you have left our Services, and those third parties may not honor “Do Not Track” requests you have set using your browser or device. We may use this data to customize content for you that we think you might like, based on your usage patterns. We may also use it to improve our Services; for example, this data can tell us how often users use a particular feature of our Services, and we can use that knowledge to make our Services useful to as many users as possible.
How does VideoShops use Personal Information?
We Process Personal Information for a variety of business purposes, including: To Provide the Services or information requested by You. VideoShops will use your Personal Information to provide its Services. For example, if you have a VideoShops account, VideoShops will use your Personal Information in connection with your transactions with Merchants, including to (i) facilitate processing payments for purchases on VideoShops; (ii) verify your identity to approve transactions, and monitor your online behavior to identify potentially fraudulent, prohibited or illegal transactions (including through the use of automated decision making technologies); (iii) communicate with you about your purchases, e.g. to provide shipping and returns updates; and (iv) to personalize your shopping experience in VideoShops.
For Administrative Purposes. VideoShops may use your Personal Information for our administrative purposes, including (i) to respond to your questions, comments, and other requests for customer support, technical support, or information, including information about potential or future services; (ii) to provide you access to certain areas, functionalities, and features of the Services; (iii) for internal quality control purposes; (iv) if you have a VideoShops Account, Seller Account or Merchant Account, to communicate with you about your VideoShops account and the Services, including by sending emails to the email address you provide to us to verify your account and for informational and operational purposes, such as account management, customer service, or system maintenance, and changes to VideoShops policies; (v) to enforce our agreements; and (vi) to generally administer the Services.
To Market the Services. VideoShops may use Personal Information to market the Services as permitted by applicable law. Such uses include (i) notifying you about offers and services that may be of interest to you; (ii) tailoring content, advertisements, and offers for you; (iii) conducting market research; (iv) developing and marketing new products and services, and measure interest in VideoShops Services; (v) other purposes disclosed at the time you provide Personal Information; and (vi) as you otherwise consent.
De-identified and Aggregated Information Use. VideoShops may use Personal Information and other information about you to create de-identified and/or aggregated information. De-identified or aggregated information is not Personal Information, and VideoShops may use such information in a number of ways, including the measurement of visitors’ interest in and use of various portions or features of the Services, for research, internal analysis, analytics, and any other legally permissible purposes.
Cookies and Similar Technologies. We, as well as third parties that provide content, advertising, or other functionality on the Services, may use cookies, pixel tags, local storage, and other technologies to automatically collect information through the Services. We use technologies that are essentially small data files placed on your device that allow us to record certain pieces of information whenever you visit or interact with the Services. If you would like to opt out of the technologies we employ on the Services, you may do so by blocking, deleting, or disabling them as your browser or device permits. Will VideoShops disclose any of the Personal Information it receives?
We may share your Personal Information with third parties as described in this section:
Merchant(s). As previously mentioned, VideoShops also processes your personal data from Merchants you interact or shop with in order to provide business services to our Merchants. We may disclose any information we receive from you with the Merchant from whom you purchase or seek to purchase products or services to facilitate and support your transaction. When VideoShops processes personal data in this way, we are acting at the direction of the Merchant, and the Merchants' terms of service and privacy policy apply (VideoShops’ policies do not apply). We are not responsible for the privacy and security practices of Merchants.
Service Providers. We may disclose any information we receive with service providers that help us provide the Services. The types of service providers to whom we entrust Personal Information include service providers for: (i) the provision of the Services; (ii) the provision of hosting, IT and related services; (iii) the provision of information and services you have requested; (iv) payment processing; and (v) customer service activities.
Affiliates. VideoShops may disclose Personal Information with our Affiliates for our and our Affiliates’ internal business purposes or to provide you with a service that you have requested. “
Affiliate” means any entity that, directly or indirectly, controls, is controlled by, or is under common control with VideoShops.
Agents. We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide the Services to you (“
Agents”). Unless we tell you differently, our Agents do not have any right to use the Personal Information we share with them beyond what is necessary to assist us. Note that an Agent may also be considered a “Business Partner” in certain circumstances and would be subject to the terms of the “Identity Removed” Information section above.
Business Partners. VideoShops may also provide Personal Information to third party businesses with whom we may jointly offer products or services, or whose products or services we believe may be of interest to you (“
Business Partners”).
Advertising Partners. Through the Services, VideoShops may allow third-party partners to set technologies (e.g., cookies) to collect information regarding your activities (e.g., your IP address, cookie identifier, page(s) visited, time of day) (“
Advertising Partners”). These Advertising Partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit non-VideoShops related websites within their networks. This practice is commonly referred to as “interest-based advertising” or “personalized advertising.” If you prefer that we do not share your Personal Information with third party advertising partners, you may opt out of such sharing by following the instructions in our Cookie Policy.
Disclosures to Protect Us or Others. We may access, preserve, and disclose any information we have associated with you if we believe doing so is required or appropriate to: (i) comply with law enforcement or national security requests and legal process, such as a court order or subpoena; (ii) respond to your requests; (iii) protect your, our or others rights, property, or safety; (iv) enforce VideoShops policies or contracts; (v) collect amounts owed to VideoShops; (vi) prevent physical harm or financial loss or in connection with an investigation or prosecution of suspected or actual illegal activity; or (vii) carry out actions that we believe are otherwise necessary or advisable. In addition, from time to time, server logs may be reviewed for security purposes – e.g., to detect unauthorized activity on our services. In such cases, server log data containing IP addresses may be shared with law enforcement bodies in order that they may identify users in connection with their investigation of unauthorized or illegal activities.
Merger, Sale, or Other Asset Transfers. We may choose to buy or sell assets, and may share and/or transfer customer information in connection with the evaluation of and entry into such transactions. Also, if we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider, or if we go through some other change of control; then your information may be sold or transferred as part of such a transaction as permitted by law and/or contract.
International Data Transfers. All Personal Information collected by VideoShops will be transferred to and stored in the United States. By choosing to visit our website, utilize the Services or otherwise provide information to us, you acknowledge that your Personal Information may be transferred to countries outside of your country of residence, including the United States, which may have different data protection rules to those of your country. Your personal data may be disclosed to employees, representatives, or other third parties operating outside of the country you are based and who work for, or are engaged by us, or our subsidiaries in other countries, including the United States and in other countries that we operate, and to our service providers who may be located outside of the country you are based, including the United States and in other countries that we operate. We note that these persons and third parties may also store, transfer, or access personal data outside of the country you are based. In disclosing your personal data overseas, we will take such steps as are reasonable in the circumstances to require that overseas recipients protect your personal data in accordance with applicable laws.
“Identity Removed” Information. We may “de-identify” your Personal Information so that you are not identified as an individual, and provide that information to our partners, including analytics providers. We may also provide aggregate usage information to our partners (or allow partners to collect that information from you), who may use such information to understand how often and in what ways people use our Platform, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage or “de-identified” information to a partner (or allow a partner to collect such information) in a manner that would identify you as an individual person.
User Profiles and Submissions. Certain user profile information, including your name, location, and any video or image content that such user has uploaded to our Platform, may be displayed to other users to facilitate user interaction within the Platform or address your request for our services. Please remember that any content you upload to your public user profile, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in messages and chat areas, etc.) becomes publicly available, and can be collected and used by anyone. We may also share this information with our brand partners or affiliates. Your user name may also be displayed to other users if and when you send messages or comments or upload images or videos through the Platform and other users can contact you through messages and comments.
Protection of VideoShops and Others. We reserve the right to access, read, preserve, and disclose any information that we believe is necessary to comply with law or court order; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of VideoShops, our employees, our users, or others.
How to exercise your rights
You may have choices about our use and disclosure of your Personal Information: Direct Marketing Email. If you receive an unwanted email from us, you can use the unsubscribe link found at the bottom of the email to opt out of receiving future emails, and we will process your request within a reasonable time after receipt. We may also send you certain non-promotional communications regarding VideoShops and our Services and you will not be able to opt out of those communications.
Do Not Track. Do Not Track (“
DNT”) is a privacy preference that users can set in certain web browsers. DNT is a way for users to inform websites and services that they do not want certain information about their webpage visits collected over time and across websites or online services. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
Your Privacy Rights. In accordance with applicable law, you may have the right to: (i) request confirmation of whether we are processing your Personal Information; (ii) obtain access to or a copy of your Personal Information; (iii) receive an electronic copy of Personal Information that you have provided to us, or ask us to send that information to another company (the “right of data portability”); (iv) object to or restrict our uses of your Personal Information; (v) seek correction or amendment of inaccurate, untrue, incomplete, or improperly processed Personal Information; (vi) withdraw your consent; and (vii) request erasure of Personal Information held about you by us, subject to certain exceptions prescribed by law. If you would like to exercise any of these rights, please contact us as set forth below. We will process such requests in accordance with applicable laws. To protect your privacy, we will take steps to verify your identity before fulfilling your request.
Data RetentionVideoShops retains the Personal Information we receive as described in this Privacy Policy for as long as you use the Services or as necessary to fulfill the purpose(s) for which it was collected, provide our services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
Is Personal Information about me secure?
We take steps to ensure that your information is treated securely and in accordance with this Privacy Policy. Unfortunately, the Internet cannot be guaranteed to be 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized disclosure. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your sign-on mechanism appropriately and limiting access to your computer or device.
What Personal Information can I access?
Through your account settings, you may access, and, in some cases, edit or delete the following information you’ve provided to us. Personal Information includes images and videos you have uploaded to VideoShops’ website. The information you can view, update, and delete may change as the Services changes.

What choices do I have?
You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some features of our Platform. You may be able to add, update, or delete information as provided above. When you update information, however, we may maintain a copy of the unrevised information in our records. You may disable your Account at any time. Some information may remain in our records after your deletion of such information from your Account. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.
State Law
State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information.
California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:· Confirm whether we process their personal information.· Access and delete certain personal information.· Correct inaccuracies in their personal information, taking into account the information's nature processing purpose (excluding Iowa and Utah).· Data portability.· Opt-out of personal data processing for:· targeted advertising (excluding Iowa);· sales; · profiling in furtherance of decisions that produce legal or similarly significant effects (excluding Iowa and Utah).· Either limit (opt-out of) or require consent to process sensitive personal data.

Nevada provides its residents with a limited right to opt-out of certain personal information sales. Residents who wish to exercise this sale opt-out rights may submit a request by email to
hi@videoshops.com. However, please know we do not currently sell data triggering that statute's opt-out requirements.
